Terms of Use

By accessing or using the Ascendants platform at ascendants.app (“Service”), you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. By using the Service, you represent and warrant that you meet these requirements.

You must provide accurate, complete, and current information when registering an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at legal@ascendantsmarketing.com if you suspect unauthorized access.

You may use the Service solely for lawful business purposes related to lead generation, distribution, buying, and brokering in compliance with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and applicable state regulations.

You agree not to:

• Upload, distribute, or transmit leads obtained through deceptive, fraudulent, or unlawful means
• Use the Service to violate any applicable law or regulation
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract data without written permission
• Transmit malware, viruses, or other harmful code
• Impersonate any person or entity, or misrepresent your affiliation
• Resell or sublicense access to the Service without prior written consent

You are solely responsible for ensuring that all lead data you upload, post, or distribute through the Service has been collected in compliance with applicable law, including obtaining required consents. You indemnify Ascendants Marketing LLC against any claims arising from non-compliant lead data.

Fees for the Service are as described on the platform at the time of purchase. All fees are in USD and non-refundable unless expressly stated otherwise. We reserve the right to modify pricing with 30 days' notice.

All content, features, and functionality of the Service — including text, graphics, logos, and software — are owned by Ascendants Marketing LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ASCENDANTS MARKETING LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, ASCENDANTS MARKETING LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Ascendants Marketing LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.

We may suspend or terminate your account at any time for violation of these Terms, without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Florida.

We may update these Terms from time to time. We will notify you by posting the revised Terms with a new effective date. Continued use of the Service constitutes acceptance.
